These Terms of Service (“Terms”) are a legal agreement between you and Wowkido, LLC d/b/a Wabi Baby (“Wabi Baby,” “Wabi,” “we,” “us,” “our”). They cover your use of our websites, content, products, and services (together, the “Services”).

By using the Services or buying from us, you agree to these Terms. If you do not agree, do not use the Services.

2) Who can use our Services

  • You must be 18+ (or the age of majority where you live) to purchase from our site.

  • By using the Services, you confirm you meet this requirement.

We may update these Terms from time to time. The “Last updated” date at the top shows when the latest changes were posted. If you continue using the Services after changes are posted, you accept the updated Terms.

5) Orders, pricing, and payment

Order acceptance

  • Placing an order is an offer to buy.

  • We may accept, reject, or cancel any order, including due to suspected fraud, inventory issues, pricing errors, or shipping restrictions.

Pricing and errors

  • Prices and promotions can change at any time.

  • If something is listed with incorrect pricing or details, we may cancel the order and refund you.

Taxes

  • We collect sales tax where required by law.

Payment processing

  • Payments are processed by third-party payment processors.

  • We do not store full payment card numbers on our servers.

8) Subscriptions (if offered)

If we offer subscriptions or auto-ship, the subscription terms shown at checkout apply. This includes billing frequency, renewals, and cancellation rules.

9) Promotions, discount codes, and gift cards

  • May be limited to one per customer or order

Gift cards (if sold)

  • Non-refundable except where required by law

10) Accounts

If you create an account:

  • Keep your login information secure

  • You are responsible for activity under your account

  • Notify us right away if you suspect unauthorized use

11) Intellectual property

All content on the Services is owned by Wabi Baby or our licensors. This includes text, images, product designs, graphics, logos, videos, and software.

You may not, without our written permission:

  • Copy, reproduce, distribute, modify, or create derivative works from our content

  • Publicly display or exploit our content

This does not restrict normal browsing and shopping use.

12) User content (reviews, photos, videos, comments)

If you submit content (reviews, photos, videos, testimonials, comments):

  • You confirm you have the rights to share it.

  • You grant Wabi Baby a worldwide, royalty-free license to use it for business purposes, including marketing, in any media.

  • Your content must not be illegal, misleading, abusive, or infringing.

We may remove user content at any time.

13) Prohibited conduct

You agree not to:

  • Break any law or regulation

  • Infringe intellectual property rights

  • Attempt unauthorized access to our systems

  • Interfere with site security or functionality

  • Send malware, spam, or harmful code

  • Scrape or use automated tools to access the site without permission

  • Abuse the return process, including returning used items as new

14) Third-party services and links

Our Services may link to third-party sites or tools. We do not control them and are not responsible for their content, policies, or practices. Use them at your own risk.

15) Disclaimer of warranties

To the fullest extent allowed by law, the Services and products are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.

16) Limitation of liability

To the fullest extent allowed by law, Wabi Baby and its owners, employees, agents, and suppliers are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill related to:

  • Your use of or inability to use the Services

  • Your purchase or use of products

  • Unauthorized access to our systems

  • Errors, interruptions, or security incidents

In all cases, our total liability for any claim will not exceed the amount you paid to Wabi Baby for the product or Services that gave rise to the claim during the 12 months before the event.

Some jurisdictions do not allow certain limits, so parts of this section may not apply to you.

17) Indemnification

You agree to defend, indemnify, and hold harmless Wabi Baby from claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from:

  • Your violation of these Terms

  • Misuse of products

  • Infringement of third-party rights

  • Your user content

18) Texas law and where disputes must be filed

Governing law

  • These Terms are governed by Texas law, without regard to conflict-of-law rules.

Informal resolution first

  • Before filing a legal claim, contact cs@wabibaby.com.

  • Give us 30 days to try to resolve the issue.

Venue

  • If a dispute is not resolved, and to the extent permitted by law, any lawsuit must be brought in the state or federal courts located in Collin County, Texas.

  • You consent to personal jurisdiction and venue in those courts.

19) Severability

If any part of these Terms is found unenforceable, the rest remains in effect.

20) Entire agreement

These Terms, plus the policies posted on our site (including Privacy, Shipping, Returns and Refunds, and any Warranty terms), are the full agreement between you and Wabi Baby about the Services and replace prior agreements on the same subject.
